The purposes, legal bases and periods of personal data processing are indicated separately for each processing purpose (see: description of individual personal data processing purposes below).

Rights. GDPR grants you the following potential rights related to the processing of your personal data:

For our part, we consider it necessary to explain that the above rights are not absolute and will not apply to all processing operations concerning your personal data. For your convenience, we have made every effort to indicate, within the description of individual personal data processing operations, the rights available to you in those operations.

If you believe that we have violated personal data protection regulations while processing your personal data, you may lodge a complaint with the supervisory authority.

You can also always contact us with a request to provide information about what data we hold about you and for what purposes we process it. Simply send a message to [email protected]. However, we have made every effort to present the information of interest to you comprehensively in this privacy policy. All entities to which we entrust personal data processing guarantee the use of appropriate protection and security measures for personal data required by law.

Purposes and processing activities

User account.
When creating a user account, you must provide your e-mail address and define an account password. Providing data is voluntary, but necessary to create an account. As part of editing your user profile, you may provide further data about yourself. Providing this data is entirely voluntary. You may have an account without providing such further data. In that case, when placing an order, you will have to enter this data manually.

The data entered by you within the user account is processed solely to maintain the account and provide you with the possibility of using it. Providing data in the user account is intended to make it easier for you to use the services provided by the PDC.

The legal basis for processing your personal data within the user account is the performance of the account agreement that you conclude on the basis of the website terms and conditions – Article 6(1)(b) GDPR.

Data collected in the user account is processed within the afaktury.pl system and stored on a server provided by the server hosting provider with which the company has appropriate data processing agreements.

Your data will be processed within the account for as long as you have a user account. After the account is deleted, your data will be removed from the database, except for data relating to placed orders.

You can access your personal data processed within the account at any time by logging in to your user account. After logging in to the account, you may modify your data at any time, as well as delete it, except for data relating to placed orders. You may also decide to delete the account at any time.

You also have the right to data portability with respect to data collected in the user account, as referred to in Article 20 GDPR.

Provision of service
If you want to use the service, you must provide the data necessary to launch it, i.e. first and last name, billing address, delivery address, e-mail address, telephone number. Providing data is voluntary, but necessary to launch the service (hereinafter “Order”).

Data provided to us in connection with launching the service is processed for the purpose of providing the service (Article 6(1)(b) GDPR), issuing an invoice (Article 6(1)(c) GDPR), including the invoice in our accounting records (Article 6(1)(c) GDPR), and for archival and statistical purposes (Article 6(1)(f) GDPR).

Data included in an order placed through the website is processed within the afaktury.pl system and stored on a server provided by the server hosting provider with which our company has an appropriate data processing agreement.

If you have a user account, your order will be visible in the order history of that account.

Each order is documented with an invoice.

Orders are also registered in our internal database for archival and statistical purposes.

Order data will be processed for the time necessary to provide the service and then until the limitation period for claims arising from the concluded agreement expires. In addition, after this period expires, the data may still be processed by us for statistical purposes. Also remember that we are required to store invoices containing your personal data for 5 years from the end of the tax year in which the tax obligation arose.

In the case of order data, you cannot rectify this data after the order has been completed. You also cannot object to processing or request deletion of the data until the limitation period for claims arising from the concluded agreement expires. Similarly, you cannot object to processing or request deletion of data contained in invoices. After the limitation period for claims arising from the concluded agreement expires, you may, however, object to our processing of your data for statistical purposes and request deletion of your data from our database. You also have the right to data portability with respect to order data, as referred to in Article 20 GDPR.

Complaints

If you submit a complaint, you provide us with personal data included in the complaint, comprising first and last name, residential address, telephone number, e-mail address, bank account number.

Data provided to us in connection with submitting a complaint is used to conduct the complaint procedure (Article 6(1)(c) GDPR).

The data will be processed for the time necessary to conduct the procedure. Complaints and statements of withdrawal from the agreement may also be archived for statistical purposes.

In the case of data included in complaints, you cannot rectify this data. You also cannot object to processing or request deletion of the data until the limitation period for claims arising from the concluded agreement expires. After the limitation period for claims arising from the concluded agreement expires, you may, however, object to our processing of your data for statistical purposes and request deletion of your data from our database.

E-mail contact.

When contacting us by e-mail, including by sending an inquiry through the contact form, you naturally provide us with your e-mail address as the sender's address. In addition, you may include other personal data in the message content.

In this case, your data is processed in order to contact you, and the basis for processing is Article 6(1)(a) GDPR, i.e. your consent resulting from initiating contact with us. The legal basis for processing after the contact ends is a legitimate purpose in the form of archiving correspondence for internal needs (Article 6(1)(c) GDPR).

The content of correspondence may be archived and we cannot clearly determine when it will be deleted. You have the right to request presentation of the history of correspondence you have conducted with us (if it has been archived), as well as to request its deletion, unless archiving is justified due to our overriding interests, e.g. defense against potential claims on your part.
